1.1 Information You Provide Directly

When you join the Nomiqon waitlist or create an account, we collect your email address and any other information you voluntarily submit through our forms. We do not require you to provide sensitive personal information to join our waitlist.

1.2 Technical and Usage Data

We automatically collect certain technical information when you interact with our platform, including your IP address, browser type and version, operating system, referring URLs, pages viewed, and timestamps of your interactions. This data is collected via server logs and analytics tools.

1.3 Agent and Transaction Data

When you use the Nomiqon API to create and manage AI agent identities, we collect data related to those agents, including cryptographic identifiers, wallet addresses, spending policy configurations, transaction records, and API call logs. This data is processed to provide core platform functionality and is subject to the security controls described in Section 6.

1.4 Communications

If you contact us for support or correspond with us by email, we retain those communications and any information contained within them in order to respond to your inquiry and improve our service.

We use the information we collect for the following purposes:

2.1 Service Delivery

To operate, maintain, and improve the Nomiqon platform, including processing agent identities, enforcing spending policies, settling transactions on the Solana blockchain via USDC, and providing API access to authorized developers.

2.2 Communications

To send you product updates, security notices, technical alerts, and — where you have opted in — marketing communications about Nomiqon features and early access releases. You may unsubscribe from marketing communications at any time by following the link included in every email.

2.3 Security and Fraud Prevention

To monitor, detect, and prevent unauthorized access, fraudulent activity, policy violations, and other harmful conduct. Given that Nomiqon facilitates financial transactions for AI agents, security monitoring is a core operational requirement and a legitimate interest under applicable data protection law.

2.4 Legal Compliance

To comply with applicable laws and regulations, including anti-money laundering (AML) obligations, know-your-customer (KYC) requirements where applicable, and any court orders or lawful requests by public authorities.

2.5 Analytics and Product Improvement

To analyze aggregated, anonymized usage data to understand how the platform is used, identify areas for improvement, and develop new features.

3.1 Service Providers

We share your information with carefully selected third-party service providers who assist us in operating the platform, including cloud infrastructure providers (such as Supabase for database services), blockchain infrastructure providers (Solana network), analytics providers, and email delivery services. These providers are contractually bound to process your data only as directed by us and in accordance with applicable privacy law.

3.2 Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or substantially all of our assets, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on our website before your data is subject to a different privacy policy.

3.3 Legal Requirements

We may disclose your information if required to do so by law, regulation, or valid legal process, or if we believe in good faith that such disclosure is necessary to protect the rights, property, or safety of Nomiqon, our users, or the public.

3.4 No Sale of Personal Data

We do not sell, rent, or trade your personal information to third parties for their own marketing or commercial purposes.

Nomiqon uses the Solana blockchain to settle transactions initiated by AI agents. Transactions recorded on a public blockchain are, by their nature, permanent and publicly visible. While we do not associate your personal identity with on-chain wallet addresses in our public-facing systems, you should be aware that blockchain data is inherently transparent. We design our systems to minimize the linkability of on-chain data to your personal identity, but we cannot guarantee complete anonymity of on-chain activity.

We retain your personal information for as long as necessary to provide our services, comply with our legal obligations, resolve disputes, and enforce our agreements. Waitlist email addresses are retained until you unsubscribe or request deletion. Transaction and agent identity records are retained for a minimum of seven (7) years to comply with financial record-keeping requirements. You may request deletion of your account data at any time by contacting us at privacy@nomiqon.com, subject to our legal retention obligations.

We implement technical and organizational measures designed to protect your information against unauthorized access, loss, destruction, or alteration. These measures include TLS encryption for all data in transit, AES-256 encryption for data at rest, isolated database environments per customer, cryptographic signing of agent identities, regular security audits, and strict access controls for employees and contractors.

No method of transmission over the Internet or method of electronic storage is completely secure. While we strive to protect your personal information using commercially reasonable safeguards, we cannot guarantee its absolute security. Depending on your jurisdiction, you may have the following rights regarding your personal information:

Access and Portability

You have the right to request a copy of the personal data we hold about you in a structured, commonly used, and machine-readable format.

Correction

You have the right to request correction of inaccurate or incomplete personal data.

Deletion

You have the right to request that we delete your personal data, subject to our legal obligations to retain certain records.

Objection and Restriction

You have the right to object to or request restriction of certain processing activities, particularly where we rely on legitimate interests as the legal basis for processing.

Withdrawal of Consent

Where processing is based on your consent, you may withdraw that consent at any time without affecting the lawfulness of processing before withdrawal.

Our platform integrates with third-party services including Supabase (database), Solana (blockchain), and analytics providers. When you interact with these services through Nomiqon, you may be subject to their respective privacy policies. Nomiqon is not directed to individuals under the age of 18, and we do not knowingly collect personal information from minors. If we become aware that we have collected personal information from a child under 18 without verifiable parental consent, we will take steps to delete that information promptly.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will notify you by updating the effective date at the top of this policy and, where appropriate, by sending an email to the address on file. Your continued use of the platform after the effective date of any changes constitutes your acceptance of the revised policy.
